Petition to Bestow Rights of Farmers to Price Their Produce - CCI
Competition Act 2002 mandates the Competition Commission of India (CCI) to prevent abuse of dominant power. Despite the absolute trade dominance in agri produce markets, to the extent that the farmers are not a part of price negotiations. The petition made to CCI makes a case for the Commission to intervene on the matter, which is essentially due to absence of necessary regulatory controls on the market resulting in dominance of trade.
Clause 19(4) of the Act, (g) refers to conditions of dominance arising out of monopoly or dominant position whether acquired as a result of any Statute or (h) regulatory barriers; in this case due to absence of a Satute or Regulation on price discovery and volatility management, is a cause for the system working against the interest of farmers.
